1. Services

Nick Joseph Design provides professional landscape design services including, but not limited to, outdoor living space planning, landscape layout design, and planting plans. All designs are conceptual plans intended to guide installation. Final construction, installation methods, and site conditions are the responsibility of the contractor or installer.

 

2. Client Responsibilities

The client agrees to provide accurate information regarding property boundaries, easements, underground utilities, HOA requirements, and local regulations. Nick Joseph Design is not responsible for issues arising from inaccurate or incomplete information provided by the client. The client is responsible for obtaining any required permits, approvals, or inspections unless otherwise agreed in writing.

 

3. Design Process

Landscape design services may include consultations, concept plans, revisions, and final design documents as specified in the project agreement. The number of design revisions included in the service will be outlined in the project proposal. Additional revisions may incur additional fees.

 

4. Payment Terms

Payment is due in full as outlined in the design agreement 

Deposits are non-refundable. 

 

5. Cancellations and Refunds

If the client chooses to cancel the project after work has begun, no refund will be granted.

 

6. Design Ownership and Use

All landscape designs, drawings, renderings, and documents created by Nick Joseph Design, remain the intellectual property of the designer unless otherwise stated in writing. The client is granted a license to use the design for installation at the specified property address only. Designs may not be reproduced, resold, or used for other properties without written permission.

 

7. Installation and Construction

Nick Joseph Design may provide design recommendations and contractor suggestions; however, we are not responsible for installation work performed by third-party contractors. Construction costs, material availability, and site conditions may affect the final outcome of the project.

 

8. Plant and Material Availability

Plant materials, hardscape products, and other materials specified in the design are subject to availability and seasonal conditions. Substitutions of similar materials may be necessary during installation.

 

9. Limitation of Liability

Nick Joseph Design shall not be liable for damages resulting from installation errors, contractor workmanship, site drainage issues, soil conditions, plant failure, weather events, or improper maintenance.

 

10. Site Conditions

Design recommendations are based on visible conditions and information provided by the client. Hidden site conditions such as underground utilities, poor soil, drainage problems, or structural issues may require modifications to the design.

 

11. Photography and Portfolio Use

Nick Joseph Design reserves the right to photograph completed projects for marketing, portfolio, and promotional purposes unless otherwise requested in writing by the client.

 

12. Governing Law

These Terms and Conditions shall be governed by the laws of the State of Ohio.

 

13. Acceptance

By purchasing services from Nick Joseph Design, the client acknowledges and agrees to these Terms and Conditions.
